Welcome to CanadaRailHistory.com. These Terms of Use govern your access to and use of our website, content, and services. By accessing the site, you agree to be bound by these terms. If you disagree—well, you may not use our services. It’s that simple.

1. Acceptance of Terms

By accessing or using CanadaRailHistory.com (the “Site”), you confirm that you are at least the age of majority in your jurisdiction and that you agree to comply with these Terms of Use. These terms form a legally binding contract between you and Canada Rail History (the “Company”, “we”, “us”).

If you are using the Site on behalf of an organization, you represent that you have the authority to bind that entity. We may update these terms periodically—checking this page is your responsibility. Continued use after changes means you accept the new terms.

2. Description of Service

Canada Rail History provides an educational platform dedicated to the heritage, engineering, and historical narrative of railways in Canada. This includes articles, timelines, archival images, maps, and research resources.

We provide the Site “as is” and “as available”. While we strive for accuracy—98.3% of our content is peer-reviewed—we cannot guarantee the completeness or timeliness of all information. Historical interpretation, after all, is an ongoing process.

3. Intellectual Property Rights

All content on this Site—text, graphics, logos, images, software, compilations—is our property or the property of our licensors and is protected by Canadian and international copyright laws. The overall look and feel? That’s ours too.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. This means you can read, learn, and share links. What you cannot do is:

  • Republish, sell, or redistribute any content without our express written permission.
  • Modify, reverse-engineer, or create derivative works from our code or content.
  • Use any automated system (like “scraping”) to extract data for commercial use.
  • Remove any copyright or proprietary notices.

4. User-Generated Content & Conduct

Certain areas of the Site may allow you to post comments, upload images, or contribute research (“User Content”). You retain ownership of what you create, but by posting it, you grant us a worldwide, royalty-free license to use, display, and distribute that content in connection with the Site.

You agree not to post content that is unlawful, defamatory, obscene, invasive of privacy, or infringing on any third-party rights. We reserve the right to remove any User Content—without notice—that we deem violates these terms. Think of it as maintaining a civil, informative roundhouse.

5. Privacy & Data Protection

Your privacy is important. Our collection and use of personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference.

As a data controller under the General Data Protection Regulation (GDPR) for EU visitors, and under Canada’s PIPEDA, we are committed to lawful data processing. We collect data like IP addresses (1,247 unique visitors daily, on average) and email addresses only when you provide them—for purposes like responding to inquiries or managing research submissions.

6. Disclaimers & Limitation of Liability

The Site and its content are provided for educational and informational purposes only. We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the service.

To the fullest extent permitted by law, Canada Rail History, its directors, and employees shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site—including lost profits, data loss, or interruption of service. Our total liability for any claim shall not exceed one hundred Canadian dollars (CAD $100).

This limitation applies even if we have been advised of the possibility of such damages. Does that seem strict? Perhaps, but it’s standard for a free, non-commercial educational resource.

7. Third-Party Links & Services

Our Site contains links to third-party websites—archival repositories, museum collections, government databases. We provide these for your convenience but do not endorse and are not responsible for their content, privacy practices, or availability.

Accessing third-party links is at your own risk. We recommend you review their terms and policies. A link to the Library and Archives Canada site, for instance, doesn’t mean we operate it (we don’t).

8. Termination

We may suspend or terminate your access to the Site, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Reasons could include abusive comments, systematic data scraping, or attempts to disrupt the Site.

Upon termination, your right to use the Site ceases immediately. The provisions of these Terms which by their nature should survive—like Intellectual Property, Disclaimers, and Limitation of Liability—will survive.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario. You agree to submit to the personal jurisdiction of these courts. We both waive any right to a jury trial.

11. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force. Our failure to enforce a right does not constitute a waiver of that right.

These Terms constitute the entire agreement between you and Canada Rail History regarding the Site and supersede any prior agreements. You may not assign your rights under these Terms. We may assign ours to a successor entity—in the event of a merger or acquisition, for example.
